In New York State, police may confiscate condoms as evidence of intent to engage in prostitution 0r loitering for the purpose of engaging in a prostitution offense. Consequently, sex workers and people who are suspected of being sex workers, including LGBT folks, are discouraged from carrying condoms for fear of arrest and prosecution. This negatively affects the health of our communities and public health outreach efforts. A bill before the New York State Legislature would stop this dangerous practice.
